2. Guide of the Information Regulator (Section 10 of PAIA)

The Information Regulator has compiled a comprehensive guide containing such information as may reasonably be required by a person who wishes to exercise any right contemplated in the Promotion of Access to Information Act, 2000 (PAIA) and the Protection of Personal Information Act, 2013 (POPIA).

3. Records Automatically Available Without Formal Request

Under Section 52 of PAIA, the following categories of records are automatically available to the public on our website or upon simple request without submitting a formal Form 2 application:

  • Public prospectus, course brochures, and curriculum outlines.
  • Public marketing material, newsletters, press releases, and news articles.
  • Institutional accreditation information (Boland College partnership, CompTIA, Cisco, Pearson VUE).
  • Public website policies (Website Policy, POPIA Compliance Policy, this PAIA Manual).
  • General contact information and campus facilities summaries.

4. Categories of Records Held at the Academy

The Academy maintains records across five core functional areas:

A. Governance and Legal Records

Memorandum of Incorporation (MOI), CIPC registration documents, NPO certificate, Board resolutions, minutes of directors' meetings, institutional policies, and compliance registers.

B. Financial and Operational Records

Annual financial statements, tax records, auditor reports, banking statements, asset register, donor and sponsorship agreements, grant documentation, and supplier invoices.

C. Academic and Student Records

Learner application files, disability confirmation certificates, assessment and examination results, attendance records, certificate registers, Boland College joint registration files, and hostel residency agreements.

D. Human Resources and Personnel Records

Employment contracts, job descriptions, employee records, payroll records, leave records, performance reviews, UIF and PAYE records, and staff training registers.

E. Information Technology and Infrastructure Records

IT security logs, network infrastructure documentation, software licensing registers, assistive software configurations (JAWS, ZoomText, NVDA), and backup management logs.

5. Applicable Legislation in Terms of Which Records are Held

The Academy maintains records in accordance with the following statutes (among others):

• Basic Conditions of Employment Act 75 of 1997

• Companies Act 71 of 2008

• Continuing Education and Training Act 16 of 2006

• Electronic Communications and Transactions Act 25 of 2002

• Employment Equity Act 55 of 1998

• Income Tax Act 58 of 1962

• Non-Profit Organisations Act 71 of 1997

• Occupational Health and Safety Act 85 of 1993

• Protection of Personal Information Act 4 of 2013

• Promotion of Access to Information Act 2 of 2000

• Skills Development Act 97 of 1998

• Value Added Tax Act 89 of 1991

6. Procedure for Requesting Access to Records

To request access to a record held by the Academy, the requester must follow these steps:

  1. Submit Form 2: Complete the prescribed Form 2 ("Request for Access to Record of Private Body"), available from the Information Regulator's website.
  2. Address to Information Officer: Submit the completed form to Frederika Manefeldt at [email protected] or deliver to 20 Adderley Street, Worcester, 6850.
  3. Specify the Record: Provide sufficient detail to enable the Information Officer to identify the record requested and identify the requester.
  4. Identify the Right: State the right that the requester seeks to exercise or protect, and explain why the requested record is required.
  5. Payment of Prescribed Fee: If applicable, pay the prescribed request fee and access fee as determined by regulation.

Decision on Request:

The Information Officer will notify the requester of the decision within 30 days of receipt of the completed request. This period may be extended once for an additional 30 days under valid statutory grounds.

7. Availability of Manual & Execution

This Manual is available for inspection at the Academy's campus (20 Adderley Street, Worcester) during normal office hours, on our website, and has been lodged with the Information Regulator.
